A BILL to amend article seven-a, chapter eighteen of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
fourteen-b, relating to allowing individuals who participate
in the teachers retirement system and who, additionally,
serves in the Legislature to pay the share of the retirement
contribution for the portion of salary they would have made
but for their absence from their regular duties by virtue of
fulfilling their legislative duties.
Be it enacted by the Legislature of West Virginia:
That article seven-a, chapter eighteen of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be amended by adding thereto a new section, designated section
fourteen-b, to read as follows:
ARTICLE 7A. STATE TEACHERS RETIREMENT SYSTEM.
§18-7A-14b. Options of certain members to elect to contribute
for times of absence due to fulfillment of
legislative duties.
Notwithstanding any other provisions of this article to the
contrary, any present member of the retirement system who, as a
member of the Legislature of this state, was limited in the
amount he or she could pay into the retirement system as the
result of having been absent in order to serve as a legislator,
henceforth shall have the option to pay into the retirement
system the amount to which he or she would have been eligible and
entitled to contribute during the period of time they were
required to be absent from their regular duties as the result of
fulfilling their duties in the Legislature.
NOTE: The purpose of this bill is to allow an individual who
participates in the teachers retirement system and who,
additionally, serves in the Legislature, to pay the share of the
retirement contribution for the portion of salary they would have
made but for their absence from their regular duties by virtue of
fulfilling their legislative duties.
